Welcome to Abbey Tooling & Engineering Supplies("we", "us" or "Company"). These Terms & Services ("Terms") set out the basis on which you may use our website and purchase goods or services from us. By using the website or placing an order you agree to these Terms. If you are a natural person acting in the course of a business or on behalf of an entity, you confirm that you have authority to bind that entity to these Terms.
1. Important legal notices
These Terms are subject to applicable South African consumer and data-protection law, including the Consumer Protection Act ("CPA"), the Electronic Communications and Transactions Act ("ECTA") and the Protection of Personal Information Act ("POPIA"). Nothing in these Terms is intended to limit rights you may have as a consumer under the CPA or other mandatory legislation. If you are a consumer, you may have additional statutory rights which are not limited by these Terms.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to place an order. By placing an order you warrant that you have the legal capacity to enter into a binding contract.
3. Ordering, prices and payment
All prices are quoted in South African Rand (ZAR) and include VAT where applicable. Payment must be received before we dispatch goods. We accept the payment methods displayed at checkout; where we accept EFT, please follow the payment instructions provided. We will issue a tax invoice on request.
We endeavour to keep product information and pricing accurate, but we reserve the right to correct errors. An order is an offer to purchase and will only be accepted when we dispatch the goods or confirm acceptance in writing.
4. Delivery and risk
Delivery times are estimates only. Risk in the goods passes to you on delivery, but ownership may transfer only once we have received payment in full for the goods and any applicable taxes and fees. If goods are damaged on delivery, please notify us immediately and preserve the packaging and goods for inspection.
5. Returns, repairs and refunds
If goods are defective, not fit for purpose or not as described, you are entitled to a remedy under the CPA, which may include repair, replacement or refund. To exercise your rights, contact our customer support with your order details and a description of the issue. We will assess returns and, where appropriate, arrange collection or provide instructions for return. Refunds will be processed to the original payment method after inspection and in accordance with applicable law.
Where a return is not due to a fault, we may in our discretion accept returns subject to our Returns Policy (see Returns Policy), which sets out any restocking fees and conditions.
6. Privacy
We process personal information in accordance with POPIA and our Privacy Policy. By using our Services you consent to that processing for the purposes set out in the Privacy Policy.
7. Intellectual property
All content on the site (including text, images, logos and designs) is owned by or licensed to Abbey Tooling & Engineering Supplies or its suppliers. You may not reproduce or use our content without prior written permission.
8. Limitation of liability
To the extent permitted by applicable law, and without limiting your statutory rights, we exclude liability for indirect or consequential loss. Nothing in these Terms excludes liability for death or personal injury caused by our negligence or for any other liability that cannot be excluded under South African law.
9. Disputes and governing law
These Terms are governed by the laws of the Republic of South Africa. If you are a consumer, nothing in this clause affects your rights under applicable consumer protection legislation. Any dispute arising under these Terms will be submitted to the courts of the Republic of South Africa.
